Britain's Competition and Markets Authority designated Google with Strategic Market Status across UK search and imposed new conduct requirements, TechRadar reported. Under the rules, publishers can opt out of having their content used in AI features like AI Mode and AI Overviews without being removed from regular search results — previously, opting out also risked losing regular-search visibility. VideoWeek reported that publishers can separately control whether content is used for AI training, fine-tuning, and grounding, both inside and outside general search. The fine-tuning control closes a workaround publishers had flagged as the most likely escape hatch. Google has nine months to implement the changes and must submit regular compliance reports to the CMA.

The fine-tuning control is the part legal teams should re-read. Until today, a publisher's "no AI training" signal was easy to honor at the crawl stage and effectively impossible to enforce downstream once content had been licensed for one purpose and re-used to fine-tune for another. The CMA's rule treats grounding, training, and fine-tuning as three distinct permissions — the first time a regulator has matched the technical reality of how models actually consume content. That three-permission framework is the template every other major regulator will copy, because it is the only formulation that survives contact with how an LLM pipeline actually works. If you are a publisher, a content licensor, or anyone whose revenue model has a corpus-licensing line, the next nine months are when your licensing agreements need to be rewritten to match the three-permission model — not later, not when your counterparty asks.

Nine months is long enough that Google ships a technically-compliant control no publisher actually uses, the way GDPR consent banners became theater rather than choice.
