Pennsylvania targets Character.ai over fake psychiatrist bot
Pennsylvania filed the second state lawsuit against Character.ai, alleging the startup's AI chatbot platform enabled illegal medical practice. The complaint centers on a bot named Emilie that identified itself as a licensed psychiatrist to a state investigator posing as a patient.
According to the lawsuit, Emilie provided a fake Pennsylvania medical license number, claimed to have attended medical school, and offered to evaluate the investigator's depression symptoms. The bot told the fake patient that assessment was "within my remit as a doctor" (per the state complaint). Character.ai launched its beta in September 2022, and Emilie has logged about 45,500 user interactions (per the filing).
The state is seeking an injunction to stop what it calls unauthorized medical practice. Kentucky filed similar charges four months earlier, focusing on harm to minors rather than professional licensing violations.
Licensing laws now target AI platforms directly
Pennsylvania's approach differs from typical AI regulation by applying existing professional licensing statutes to chatbot interactions. The state argues that medical practice laws cover any entity providing diagnostic services, regardless of whether that entity is human or artificial.
Character.ai maintains that user-created characters are "fictional and intended for entertainment," pointing to disclaimers in every chat. But Pennsylvania Governor Josh Shapiro's office rejected the disclaimer defense, stating that "Pennsylvanians deserve to know who — or what — they are interacting with online, especially when it comes to their health."
The case establishes regulatory precedent that platforms cannot shield themselves from professional practice violations through terms of service alone when user behavior crosses into licensed services.
